Training for the members of ALFG

 

On June 21st, 20121, in the co-working space “Terminal”, the Association of Law Firms of Georgia (ALFG) organized a training for the member lawyers of ALFG regarding the construction law issues.

The training was led by the former Chairperson of the Supreme Court Chamber of Civil Cases, expert in the field of private law, Mrs. Mzia Todua.

The discussed topics on the training were the decisions of the general courts linked to construction, as well as the following issues:

 

  1. Whether the following agreement stipulation is null:

When abolishing the presale contract before the appointed time, the buyer gets the actual paid amount of money for purchase back only after the seller re-alienates the mentioned property on to the third party and the new buyer pays the purchase price. Or is this way of returning the money simultaneously limited in time (but, not later than…)?

 

  1. Is it possible or not to determine the termination of construction by the court as a force-majeure in the presale contact of the property?
  2. The work relations with the laborer’s, is it a service or does the labor code cover it?
  3. When the owners of the land (the inhabitants) abolish the equitable servitude contract with the developer and request that the property created as a result of the equitable servitude (the block of flats under construction) be passed on into their possession, is it possible to fulfil this request by the parts of the flats that the developer has already alienated? Etc.

 

The training was a session of active and acute discussions and 20 lawyers of ALFG participated in it.

 

The training was organized in the frames of the construction law practical course, which lasted for 4 months and concluded with the mentioned training.
